Staff and Faculty Legal Obligations

Staff and faculty who are made aware of a sexual assault are REQUIRED to report the incident to Cal Poly's Title IX Officer at 805-756-1400.

  • The Title IX Officer is required to coordinate a timely campus response which may include athletic staff, housing staff, university police, city police, the Safer Program, Office of Student Rights and Responsibilities and others.
  • If you know the name of the victim and parties involved it MUST be disclosed when you report to the Title IX Officer.
  • The victim of the sexual assault is assured support and assistance in securing physical and emotional resources, and accommodation to ensure that academic progress is not impeded.

Title IX, as directed by the Office of Civil Rights (OCR), requires Universities to take appropriate action to investigate allegations of sexual harassment, including sexual assault/violence. If sexual violence has occurred, the University must take prompt and effective steps to end the sexual violence, prevent its recurrence, and address its effects. Therefore, all employees of the University must report allegations of student on student sexual harassment/assault to the campus Title IX officer, when they have knowledge of said occurrence.

When a student sexually harasses another student, the harassing conduct creates a hostile environment if the conduct is sufficiently serious that it interferes with or limits a student's ability to participate in or benefit from the school's programs. As part of the duty to assist and support the complainant, the Title IX officer for the campus must meet with the complainant, provide assurance that the University will take steps to prevent recurrence, and to correct the discriminatory effects on the complainant. This may include, but not limited to, ensuring that the parties aren't in the same classes, moving parties to different residence halls, preventing retaliation, implementing stay-away orders, and advising the complainant as to the options available for filing a criminal complaint.

  • Campus Security Authority (CSA) = anyone who is involved with student activities must report
  • Geographically sensitive
  • If a crime occurred on campus or at a campus affiliated home (fraternity house), the incident must be reported
  • Two reasons for Clery Reporting
    1. Keep the campus safe and free of perpetrators
    2. Have a more accurate number of crimes which are occurring at Cal Poly every year
  • It is an anonymous reporting system for the university
  • You can find these forms in the Safer Office and UPD
  • Must be filled out within 24 hours of reported sexual assault
